In 2017, the U.S. Food and Drug Administration (FDA) announced its plan lower nicotine levels in cigarettes and other combustible products to “minimally-addictive or non-addictive levels.”  If the FDA eventually implements such a regulation, it could have a transformative impact on public health. Nearly a decade after this announcement, however, progress has been incremental at best, and it is unclear whether the FDA will ever issue a nicotine reduction regulation. This presentation will discuss Prof. Berman’s research on FDA regulation and nicotine reduction, the major obstacles the FDA has faced, and lessons learned that can inform international tobacco regulation.

ABOUT THE PRESENTER

Micah Berman is the Stephen F. Loebs Professor in Health Services Management and Policy at The Ohio State University’s College of Public Health and a Professor of Law at Ohio State’s Moritz College of Law. His research explores the intersection between public health research and legal doctrine, and he is a co-author of The New Public Health Law: A Transdisciplinary Approach to Practice and Advocacy (Oxford University Press). He is currently co-authoring a Global Public Health Law textbook to be published by Oxford University Press. Prof. Berman has worked on tobacco policy issues for more than 20 years and has extensive experience supporting the development, implementation, and legal defense of tobacco regulatory measures at the local, state, federal, and international levels.
